By accessing and using Fashai Studio ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Description of Service
Fashai Studio provides AI-powered fashion content creation tools including:
- Virtual try-on technology
- AI video generation
- Background editing and replacement
- Fashion content creation tools
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account with others
4. Tokens and Payment
Our Service operates on a token-based system:
- Tokens are required to generate content
- New users receive 90 complimentary tokens
- Additional tokens can be purchased
- Tokens are prepaid and non-refundable once allocated to your account
- Subscription tokens are allocated at the start of each billing cycle
- Tokens do not expire unless your account is terminated
- Prices may change with reasonable notice
5. Refund Policy
Subscription Plans
All subscription plans are billed in advance and tokens are allocated at the start of each billing cycle:
- No Automatic Refunds: Tokens are prepaid and non-refundable once allocated
- Cancellation: You may cancel your subscription at any time through your account settings
- After Cancellation: You retain access to unused tokens until the end of your current billing period
- No Future Charges: Canceled subscriptions will not be charged in subsequent billing cycles
- Usage-Based Consideration: In exceptional circumstances, partial refunds may be considered based on actual token usage within the current billing cycle
One-Time Token Purchases
Custom token purchases are final and non-refundable:
- Once tokens are added to your account, the purchase is complete
- Tokens can be used for any available service on the platform
- Tokens do not expire and remain available until used
Exceptional Circumstances
We may, at our sole discretion, offer partial refunds in cases of:
- Technical issues preventing service access
- Billing errors or duplicate charges
- Service outages affecting token usage
Refund calculations, when approved, are based on the percentage of unused tokens within the current billing cycle. All refund requests must be submitted to support@fashai.studio within 7 days of the charge.
Chargebacks
If you dispute a charge with your payment provider (chargeback) without first contacting us, your account may be immediately suspended and all content/tokens may be forfeited. We encourage you to contact us first to resolve any billing issues.
6. Content Ownership and License
Your Content
You retain ownership of all images and content you upload. By uploading content, you grant us a license to:
- Process your content using our AI tools
- Store your content on our servers
- Display your content back to you
Generated Content
You own the AI-generated content created using our Service, subject to these Terms. You may use the generated content for commercial purposes.
7. Acceptable Use Policy
You agree NOT to:
- Upload illegal, harmful, or offensive content
- Violate any intellectual property rights
- Upload images of minors
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer our AI models
- Abuse or manipulate the credit system
- Harass, spam, or abuse other users or staff
- Upload malicious files or code
8. Content Guidelines
All uploaded content must:
- Be legally obtained and owned by you or properly licensed
- Not contain nudity or sexually explicit material
- Not depict violence or illegal activities
- Not violate any third-party rights
- Comply with all applicable laws
9. Intellectual Property
The Fashai Studio platform, including all software, designs, text, graphics, and trademarks, is owned by Fairmont LLC (operating as FASHAI studio) and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Service without permission.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- Specific quality or accuracy of AI-generated content
- That all content will be successfully processed
- Fitness for a particular purpose
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASHAI STUDIO LLC SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount you paid in the past 12 months
12. Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment
- Abuse of the Service
You may terminate your account at any time by contacting support. Upon termination, unused credits will be forfeited.
13. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.
14. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will provide reasonable notice of material changes.
